Terms of Service

These Terms of Service ("Terms") govern your access to and use of the GTHR mobile application (the "App").
By creating an account or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the App.

2. Scope of the Service

GTHR currently operates solely as a digital platform that enables users to connect with each other for sports and social activities.
At this time, GTHR does not organize, host, supervise, control or manage sports events, training sessions, clubs or physical activities.

3. Future Services and Separation of Legal Entities

GTHR may, in the future, offer additional services, including the organization of events, sports activities or example clubs.
Such services may be offered by a separate legal entity, including but not limited to a future entity operating under the name “GTHR Events B.V.”
Any such services will be subject to separate terms, conditions and liability waivers.
Use of the GTHR App does not imply participation in, nor responsibility for, such future services.

4. Eligibility and Minors

The App is available to adults and minors.
If you are under the age of 16, you confirm that you have obtained permission from a parent or legal guardian to use the App.
Parents or legal guardians remain fully responsible and liable for the minor’s use of the App, including participation in activities initiated via the App.

5. No Supervision or Endorsement

GTHR does not verify users, qualifications, experience, health conditions or suitability for any activity.
The presence of groups, example clubs, demonstration initiatives or pilot activities in the App does not constitute supervision, endorsement or responsibility by GTHR.

6. User Responsibility and Assumption of Risk

You acknowledge and agree that:
Participation in sports and group activities involves inherent risks
You voluntarily assume all risks associated with such participation
You are solely responsible for assessing your physical condition, skills and safety
GTHR does not provide medical, fitness, safety or legal advice.

7. Groups, Events and Meetings

All interactions, meetings, trainings or events initiated via the App are arranged exclusively between users.
GTHR is not a party to any agreement, arrangement or interaction between users, whether online or offline.
Participation in any group or activity is entirely voluntary and at your own risk.

8. Liability Disclaimer

To the maximum extent permitted by applicable law:
GTHR shall not be liable for any injury, accident, damage, loss or death arising from participation in activities arranged through the App
GTHR shall not be liable for misconduct, negligence, criminal acts or omissions of users
GTHR shall not be liable for loss of or damage to personal property
GTHR shall not be liable for any claims, demands or actions by third parties arising from your use of the App
Nothing in these Terms excludes liability that cannot legally be excluded under Dutch or EU law, including liability for intent or gross negligence.

9. Limitation of Liability

Where liability cannot be excluded, GTHR's total liability shall be limited to:
The total amount paid by you to GTHR in the 12 months preceding the event giving rise to liability, or
If no payment was made, EUR 0
Indirect, incidental, consequential or punitive damages are excluded.

10. Indemnification

You agree to indemnify and hold harmless GTHR from any claims, damages, losses, liabilities, costs and expenses arising out of or related to:
Your use of the App
Your participation in activities
Your interactions with other users
Your violation of these Terms or applicable law
This includes claims brought by third parties.

11. User Content and Communication

You are solely responsible for all content you upload or share, including messages and photos.
GTHR reserves the right, but not the obligation, to monitor, review, restrict or remove content and to suspend or terminate accounts in case of violations or reported misconduct.

12. Account Suspension and Termination

GTHR may suspend or terminate your account at any time if you violate these Terms, misuse the App or pose a risk to others.
You may delete your account at any time via the App.

13. Advertisements

The App may display advertisements. These advertisements are not personalized based on profiling. GTHR does not sell personal data.

14. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis.
GTHR makes no warranties regarding availability, accuracy, reliability or uninterrupted operation of the App.

15. Data Protection

Personal data is processed in accordance with the Privacy Policy, which forms an integral part of these Terms.

16. Changes to the Terms

GTHR may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

17. Governing Law and Jurisdiction

These Terms are governed by Dutch law.
Any disputes shall be submitted exclusively to the competent court in the Netherlands.
